How it differs from an RFE
Where a Request for Evidence asks for missing documentation, a Notice of Intent to Deny sets out why the officer believes the case should be denied on the current record. A Notice of Intent to Revoke does the same for a previously approved petition.
These notices often reference specific evidence and specific legal standards. The response must engage with those points directly.
Structuring a rebuttal
A strong rebuttal identifies each stated ground, explains why the officer's reading of the record is incomplete or incorrect, and supplies evidence that meets the standard cited. Where the officer's concern is factually correct, the response should address it honestly and explain any applicable legal basis for approval notwithstanding.
